Welcome to Taxis4Airports.brussels. These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, and related ride-hailing services. Please read these Terms carefully before using the Service. By creating an account or using the Service as either a Rider (Passenger) or a Driver, you enter into a legally binding contract and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Application.
1. Scope of Services
The Application operates as a technology marketplace platform connecting individuals seeking transportation services ("Riders") with independent third-party transport providers ("Drivers"). Taxis4Airports.brussels does not provide transportation services itself. We are not a common carrier or motor carrier. Drivers operate independently and are not employees, agents, or subcontractors of the Company.
2. User Accounts & Eligibility
To access most features of the Application, you must register and maintain an active personal user account. You agree to the following obligations:
• Age Requirement: You must be at least 18 years of age to register an account or request rides independently.
• Account Accuracy: You must provide accurate, current, and complete information during registration and keep it updated.
• Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.
• Driver Obligations: If registering as a Driver, you must maintain a valid driver's license, commercial background checks, valid vehicle registration, and necessary commercial auto insurance matching local regulatory standards.
3. Fares, Fees, and Payment
Use of the Application will result in charges for the services you receive from the Driver ("Charges").
• Fare Estimates: Fares quoted prior to a ride are estimates and may vary based on actual route, distance, traffic conditions, or surge pricing multipliers.
• Payment Method: Charges are billed directly to the designated credit card or payment method linked to your account, inclusive of applicable taxes.
• Cancellation Fees: A cancellation fee may apply if a Rider cancels a request after it has been accepted by a Driver, or if a Rider fails to arrive at the designated pickup location within the allowed timeframe.
• Damage & Cleaning Fees: Riders are responsible for the cost of repair for damage to, or necessary cleaning of, a Driver's vehicle resulting from use of the Service under their account, in excess of normal wear and tear.
4. Acceptable Conduct & Prohibited Acts
Users agree to adhere to community guidelines designed to ensure safety and mutual respect:
• No illegal, abusive, harassing, or violent behavior toward Drivers, Riders, or members of the public.
• No intentional damage to vehicles or property.
• No carrying of hazardous materials, open alcohol containers, or illegal substances during a ride.
• No unauthorized distribution of promotional codes, platform reverse-engineering, or scraping data.
5. Limitation of Liability & Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY IS NOT RESPONSIBLE FOR THE CONDUCT, ACTIONS, OR OMISSIONS OF ANY RIDER OR DRIVER, NOR FOR THE QUALITY, SAFETY, OR LEGALITY OF THE TRANSPORTATION PROVIDED.
6. Account Termination
We reserve the right to temporarily or permanently suspend, deactivate, or terminate your account at our sole discretion, without prior notice, if you breach these Terms, violate local laws, or exhibit behavior that threatens the safety or integrity of our platform community.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Courts of First Instance.
Any dispute, controversy, or claim arising out of these Terms shall be resolved via binding arbitration or in courts located within Brussels, Belgium, except where prohibited by local consumer protection statutes.
